Why are Cuban cigars illegal in the US?

Updated November 2026

The short answer

The United States has had a trade embargo on Cuba since 1962. Cuban cigars are covered by it, so they can't be legally imported or sold in the US. The rules are run by the US Treasury's Office of Foreign Assets Control (OFAC).

Can I bring Cuban cigars back from a trip?

The rules have changed several times. A 2016 change briefly allowed travellers to bring back Cuban cigars for personal use, but that permission was later withdrawn. Check OFAC's current rules before you buy abroad, because US Customs can seize Cuban cigars.

Cuban brands you can buy legally

Several famous Cuban brand names, such as Cohiba, Montecristo, Romeo y Julieta, Partagás, H. Upmann and Punch, also exist as completely separate non-Cuban cigars made in the Dominican Republic, Honduras and elsewhere. These are legal in the US. See our pages on them below.

Beware of fakes

Cigars sold online or on the street as 'Cuban' in the US are often counterfeit. If the price seems too good or the seller can't explain the source, be cautious.
